1. Purpose of This Policy

Petesaa provides access to licensed healthcare professionals who may evaluate individuals for:

  • Emotional Support Animal (ESA) Letters
  • Psychiatric Service Dog (PSD) Letters
  • Related telehealth services

2. Americans with Disabilities Act (ADA)

The Americans with Disabilities Act (ADA) is a federal civil rights law that prohibits discrimination against individuals with disabilities in certain areas of public life, including:

  • Public accommodations
  • Employment
  • Transportation
  • Government services
  • Public facilities

The ADA provides specific protections for qualified individuals with disabilities and, in some circumstances, their service animals.

3. Service Animals Under the ADA

Under the ADA, a service animal is generally defined as:

A dog that is individually trained to perform specific tasks or work directly related to a person's disability.

Examples may include tasks such as:

  • Interrupting panic attacks
  • Providing grounding during psychiatric episodes
  • Retrieving medication
  • Assisting during dissociative episodes
  • Guiding or alerting the handler

The key requirement is that the dog must be trained to perform disability-related tasks.

4. Emotional Support Animals (ESAs)

Emotional Support Animals are not considered service animals under the ADA.

ESA letters issued through Petesaa:

  • Do not create ADA public access rights;
  • Do not qualify an animal as a service animal;
  • Do not grant access to restaurants, stores, hotels, or public accommodations under the ADA.

ESA protections may exist under certain housing laws, including the Fair Housing Act, where applicable.

5. Psychiatric Service Dogs (PSDs)

Psychiatric Service Dogs may qualify as service animals under the ADA when:

  • The individual has a qualifying disability; and
  • The dog has been individually trained to perform specific tasks directly related to that disability.

A PSD letter does not by itself create service animal status.

The dog's training and task performance remain essential legal requirements.

6. No Certification or Registration Requirement

Under the ADA:

  • Service animals are not required to be registered.
  • Service animals are not required to carry identification cards.
  • Service animals are not required to wear vests.
  • There is no federal government-issued service animal certification program.

Petesaa does not sell or issue service animal certifications, registrations, licenses, or government credentials.

7. Public Access Rights

Public access rights under the ADA are determined by applicable law and the animal's qualification as a service animal.

Businesses may generally ask only:

  1. Is the dog required because of a disability?
  2. What work or task has the dog been trained to perform?

Businesses generally may not require disclosure of a diagnosis or demand medical records.

8. User Responsibilities

Users are responsible for ensuring that any animal represented as a service animal:

  • Is individually task-trained;
  • Remains under control at all times;
  • Meets applicable legal requirements;
  • Does not pose a direct threat to others;
  • Complies with public health and safety rules.

Misrepresenting an animal as a service animal may violate state laws and may result in penalties.

9. No Guarantee of Access

Petesaa cannot guarantee:

  • Public access rights;
  • Entry into businesses;
  • Transportation access;
  • Housing accommodations;
  • Government approvals;
  • Airline acceptance.

Final determinations are made by the applicable entity in accordance with federal, state, and local laws.
